Not Guilty!

RI Criminal Defense Attorney James E. Smith is pleased to announce that after trial a Justice of the Rhode Island Superior Court dismissed a case charging client with Patient Abuse – a felony punishable by up to three years in prison.

A co-worker accused client of slapping a combative patient in the face.  However, after the State of Rhode Island presented its case, we moved the court to dismiss on the grounds that the state failed to prove beyond a reasonable doubt that client was guilty.

The judge granted our motion and client was able to keep a health care worker license, ability to keep and maintain employment in client’s chosen field, and most importantly a clean criminal record!

The Ponzi Scheme – Know What To Look For

Today, the Providence Journal reported yet another fund manager who has been sanctioned by a securities enforcement body.  We see them all the time in the press and the story is generally the same.  Some hedge fund manger is out there laying the con on unsuspecting investors with promises of high returns, early retirement and highly liquid assets.  We usually hear of them after the damage is done leaving little to no money to compensate the investor victim.

Worse, not all Ponzi Schemes are cloaked with the guise of an investment firm, nor have the notoriety of Bernie Madoff.  They can take different forms.  For example, see the matter of the Eagle Warranty Corporation.  In that case, the managers/ owners of a used car warranty company sold warranties covering used cars but refused to pay claims they authorized or were contractually bound to pay.  The Pennsylvania Attorney General’s Civil and Criminal divisions are pursuing the matter. And of course, it’s most likely too late for the victims. They probably won’t be made whole.

The reality is, there are bad people out there who are just dying to take (steal) your money. So, how can you protect yourself?  Or worse, how can you get your money back if you’ve already invested or made a purchase?  There are some things you can do and while these aren’t fool proof nor offer any guarantee for success, you might be better off thinking these over if someone who wants your money is courting you.

Ask yourself these questions, do you feel pressured by heavy-handed sales tactics?  Are you being shown amazingly good performance statistics (including few to no negative returns)?  Are you being rushed into handing over your money through an “act now before it’s too late” message?  Well, if the answer is yes, then it would be advisable to keep your checkbook in your pocket and walk away. There are hundreds, if not thousands of honest and reputable places that will guard your money, not steal it.

However, if you’ve already made the investment and you feel suspicious, call the company and ask for a withdrawal.  If that request is met with a heavy sales pitch as to why you shouldn’t then be aware. Other reasons could be driving force behind the manager’s conservation pitch. Seek advise from an attorney, call a securities regulator or do both. Time might be of the essence so act quickly.

Remember, you are in control.  You have what the con wants – your money. Be stingy. Be cynical. The con certainly won’t.

RI Criminal Defense Laywer James E. Smith Announces Case Results

RI Criminal Defense Laywer James E. Smith announces today selected case results from the week of April 6, 2015:

Case 1

Client was arrested and charged with Simple Assault – Domestic.  It was alleged by the police that the client struck a family member in the face with a closed fist.

Result – CASE DISMISSED

Case 2

Client was stopped by the police for not wearing a seatbelt.  During a search of my client’s car, police found what was later determined to be a considerable of marijuana.  Client was arrested and charged with 1. Possession with Intent to Deliver and 2. Driving While in Possession of a Controlled Substance.

After a review of the case and a bench conference client was sentenced to a one year filing on a reduced charge of simple possession of marijuana. Count number 2 was DISMISSED.  Client will be able to keep his clean criminal record after one year with no further arrests.

Palcohol and Rhode Island

Recently, The Alcohol and Tobacco Tax and Trade Bureau, approved the manufacture and sale of a product called Palcohol.  It’s alcohol sold in a variety of flavors, but in powder, not liquid form.  All one needs to do is add water and *poof!* instant cocktail.

The Rhode Island Senate has just unanimously approved legislation that would outlaw the sale and use of this product in Rhode Island. The Rhode Island House of Representatives will now consider the bill.

What do you think?  Should this product be available for Rhode Islanders’ consumption?  Does it make underage drinking easier? Wouldn’t outlawing the product be unfair to adults who may legally consume alcohol? Do you think this would potentially increase the number of DUI’s on Rhode Island roads?

Case 1

Client arrested and charged with Larceny Under $1,500.00.  Client allegedly stole a tablet computer.  After reviewing the case and negotiating with the prosecutor, RI Criminal Defense Lawyer James E. Smith secured a DISMISSAL and thereby retained client’s clean criminal record.

Case 2

Client was arrested after calling the police for help.  Client was fearful after an arguement with client’s domestic partner, but the police charged Client – the one who actually called the police for help.  Client was charged with Domestic Simple Assault & Battery and Domestic Disorderly Conduct.

Result:  Both Counts DISMISSED

Case 3
